Third Lawsuit Filed
On September 10, 2007, H&S Tool filed suit in the federal district court in southern Ohio against Ben Austerman of Miamisburg, Ohio, alleging patent infringement of H&S’ U.S. Patent Nos. 5,356,248; 5,542,177; and 6,955,507. Two of these patents are also the subject of ongoing litigation with Esco Tool and Thermal Solutions. All of the patents form a part of H&S’ patent portfolio relating to its tube repair milling heads, including but not limited to the Multi-Prep® and Multi-Prep® 2 milling head cutters. H&S’ ongoing efforts are directed to developing new products and technology to make our customers work easier, more efficient and cost effective. This recent lawsuit reflects H&S continuing efforts to pursue the enforcement of our patents in order to protect our patented inventions from unauthorized making, using or selling by unauthorized parties. H&S products are the subject of U.S. issued patents and pending patent applications. As technology moves forward, H&S intends to protect its new developments through additional patent filings. We will update our customers on the allowance and issuance of any new patents as information is received from the Patent Office.
